CONTRACT & WARRANTY

We love our puppies here at Nutmeg Farms, and we know that you will continue to give your new baby the same tender love and care that they received here. We are always here to help answer any questions you have. We want you to be 100% happy and have a wonderful experience with your new puppy. All our sires and dams are AKC registered. We recommend you spay/neuter your puppy if you do not intend to breed. We do our best to prevent umbilical hernias but they are very common with the Shih Tzu breed. They are not life threatening and can be repaired surgically, if necessary, at the same time of spay/neuter. Shih Tzu commonly snort, sniffle, and snore. A clear discharge is normal, especially when the puppy is teething. Tight nostrils are very common and normally open and correct as your puppy matures. Open fontanels (soft spots in the skull) are also common, and usually close as your puppy matures. Most Shih Tzu do not require surgical repair for these issues. If your Vet recommends repair, it is best to do at the time of spay or neuter. I do not cover any type of vet bills. Thank you for choosing us to raise your new puppy. It is truly our pleasure! The Sale of this Purebred Shih Tzu Dog is made upon the Following Terms and Conditions:

​

1. The purchase price of the puppy is $______________with Limited AKC registration. Pet delivery can be arranged to any location at the purchasers cost.  Monies are non-refundable. One quarter of the total balance is due the first week of puppy’s birth or upon selection. Remaining balance is due upon pickup after vet health clearance.  By placing a deposit, you agree to all the terms and conditions of this contract.

2. I, as the seller, further guarantee your puppy (1 year) from the date of his/her birth against life threatening congenital defects meaning the puppy will die because of this defect.  If within that time a life threatening congenital defect is found, Seller will replace this puppy with another puppy of equal quality and sex.  No money will be refunded.  Also you puppy must have all needed vaccinations by a licensed veterinarian and currently be on a heart worm preventative.  In the unlikely event of your puppy's death in (1 year), from the date of birth due to a life threatening congenital defect, a signed statement from a licensed veterinarian confirming such an event and autopsy is required.  Please note that under no circumstances will I, the Seller, be responsible for veterinary or medical bills incurred.  Autopsy must be paid by the Buyer.  If puppy dies within 1 year of birth then a necropsy must be performed by a DVM and results must be sent to the Seller in writing before a replacement puppy will be considered.  The results of the necropsy will determine whether a replacement puppy will be given.  If no puppy of equal value is available, the purchase price of said puppy will be put towards the price of one that is available.  Buyer will be responsible for the difference in prices.

3. Warranty only applies to the original buyer, warranty is not transferable if the puppy is sold.

 

4. The seller assumes no cost for shipping associated with the sale or replacement warranty.

5. To the best of the seller’s knowledge and belief, this puppy is in good, sound health, free from symptoms of contagious and infectious diseases at time of sale. Buyer agrees to have the puppy checked by Vet within 72 hours after the buyer receives the puppy. IT IS IMPORTANT FOR BUYER TO MAKE A VETERINARIAN APPOINTMENT AT THE TIME OF SELECTION BECAUSE OFTEN APPOINTMENT MUST BE SCHEDULED MONTHS IN ADVANCE.  A copy of this initial vet report must be sent to the seller within 30 days of purchase in order to activate the health warranty. No further health guarantee is made or implied. If the buyer believes this puppy to be sick, the puppy should be taken immediately to a veterinarian of the buyer’s choice at the buyer’s expense.

6. As of date of delivery, the puppy has received proper vaccinations and deworming. As stated above, this contract & warranty does not cover diseases which vaccinations could prevent (or cause) or hypoglycemia. Buyer has been informed of puppy’s need for shots & how to prevent hypoglycemia or parvo.

7. Seller is not responsible for immunity level, mites, pneumonia, mange, heatstroke, ringworm, conjunctivitis, fleas, ticks, and ear infections once puppy has left Sellers hands.  Buyer is responsible for keeping their puppy away from contaminated areas, out of heat and cold drafty places.

8. If puppy dies within 24 hours of purchase, Buyer(s) must have a necropsy performed by a licensed Veterinarian at Buyer(s) expense to determine cause of death.  If cause of death is due to problems existing before the time of purchase and after Seller's Veterinarian has examined the puppy, a replacement is given.  The replacement puppy will be of equal value.  A replacement puppy will only be given if the above puppy has been properly cared for while in Buyer(s) possession.  No monies will be given and UNDER NO CIRCUMSTANCES WILL A REPLACEMENT OF A PUPPY TAKE PLACE IF THE ABOVE CONDITIONS IN #8 ARE NOT MET.  If no puppy of equal value is available, the purchase price of said puppy will be put towards the price of one that is available.  Buyer(s) will be responsible for the difference in the price.

9. Buyer agrees the puppy will remain on a regular vet schedule and live inside the buyer’s home. Buyer agrees the puppy won’t be housed outside for long periods of time.

10. Seller cannot guarantee the size or color the puppy will be when the puppy matures. This is only estimated based on the seller’s experience. No guarantee is made or implied.

11. If puppy is purchased as a pet (Limited AKC Registration,) buyer agrees to spay/neuter and agrees not to use this puppy for breeding or stud.

12. Buyer agrees not to do a PayPal charge back for any reason.

​

13. No replacement for temperament is given, as this is environmental and the Buyer(s) responsibility.  As responsible breeders, expect that this puppy is properly socialized.  As breeders we do everything possible to produce dogs of sound mind (temperament) and body.  Some responsibility is the Buyer(s) as to proper feeding, exercise, socializing and training, of which all have a bearing on the end results of a sound adult dog.  Seller is not responsible for any damage to property that the puppy might do at any given age.  

 

14. If for any reason there should be a dispute, all discussions and/or negotiations should be made in private between Buyer(s) and Seller or through their legal representatives and not on Social Media.  Any legal action taken or any disputes, or litigations regarding this purchase will be handled in the Seller's local jurisdiction at the buyer’s expense.

This contract contains the entire agreement between the parties and no statement or verbal agreement made by either party that are not contained in this written contract shall be valid or binding.  This contract may not be modified or altered except in writing and signed by both parties.  Violations of this Contract will constitute a BREACH of CONTRACT, prosecutable by law and may result in mandatory confiscation and return of said puppy to the Seller.
